| Resumo: | O trabalho de conclusão de curso se dedica a analisar o procedimento do inventário extrajudicial, especificamente, as alterações promovidas pela Resolução 571/2024 do Conselho Nacional de Justiça e os seus impactos da desjudicialização de inventários, observando a efetivação de direitos fundamentais como o acesso à justiça e seus corolários, como direito à jurisdição efetiva e o direito à tutela adequada. Além disso, tem como principal objetivo examinar as inovações do direito sucessório, especialmente sobre a ótica da Resolução 571/2024 do Conselho Nacional de Justiça, no que diz respeito às possibilidades de tramitação de inventário extrajudicial, com vistas sobretudo, a analisar as opiniões de diversos profissionais sobre as reformas introduzidas pelo CNJ. |
| Abstract: | This research project analyzes the extrajudicial probate procedure, with a focus on the changes introduced by Resolution No. 571/2024 of the National Council of Justice and the impacts of the ongoing dejudicialization of probate proceedings. It explores the implementation of fundamental rights, such as access to justice, along with its corollaries, including the right to effective legal protection and due process. The study’s primary objective is to examine recent innovations in inheritance law—particularly through the lens of Resolution No. 571/2024—and to assess the feasibility of conducting probate proceedings extrajudicially. It also seeks to analyze the perspectives of various legal professionals regarding the reforms introduced by the National Council of Justice. |
