| Resumo: | O presente estudo tem como objetivo analisar o instituto do salário-maternidade remanescente nas situações em que deixa de cumprir sua finalidade de proteção ao segurado do Regime Geral de Previdência Social e, consequentemente, à criança e ao recém-nascido nos casos em que inexiste a figura do cônjuge ou companheiro sobrevivente. Para tanto, faz-se necessário entender o direito fundamental à vida, à seguridade social e, consequentemente, ao salário-maternidade. |
| Abstract: | This work aims to analyze the institute of remaining maternity pay, considering the situations where it fails to fulfill its purpose of protection to the insured of the Social Welfare System and therefore the child and the newborn in cases where it does not exist the figure of the surviving spouse or partner. Thus, it is necessary to understand the fundamental right to life, to social security and, as a result, the maternity pay. |
