| Resumo: | A pesquisa investiga argumentos favoráveis e contrários à diminuição da jornada de trabalho, bem como dos arranjos institucionais necessários para sua adoção. Este trabalho foi feito a partir da análise de estudos sociológicos (Dal Rosso et al., 2022), de produções de juristas sobre o tema da jornada e de pesquisa de materiais institucionais sobre o assunto, a exemplo da OIT, além de levantamento de repercussões da campanha pela redução de jornada na mídia em diferentes sites. Como resultado, tem-se que o campo do Direito do Trabalho e das experiências internacionais já vinham se abrindo à temática dos danos da jornada excessiva e das várias dimensões coletivas da jornada, embora, no Brasil, esse movimento aporte em um ambiente regulatório negativo, da reforma trabalhista. Tal ambiente reforça ideias e práticas desfavoráveis a mudanças, embora elas sejam justas e oportunas diante das novas demandas por proteção na regulação da jornada, no uso de novas tecnologias, na conciliação vida profissional e familiar e na prevenção de riscos à saúde dos trabalhadores. |
| Abstract: | The research investigates arguments for and against reducing the working day, as well as the institutional arrangements necessary for its adoption. This work was based on an analysis of sociological studies (Dal Rosso et al., 2022), the work of legal experts on the subject of working hours and research into institutional materials on the subject, such as from the ILO, as well as a survey of the repercussions of the campaign to reduce working hours in the media on different websites. The result is that the field of labor law and international experiences have already been opening up to the issue of the damage caused by excessive working hours and the various collective dimensions of working hours, although in Brazil this movement is taking place in the negative regulatory environment of the labor reform. This environment reinforces ideas and practices that are unfavorable to change, even though they are fair and timely in the face of new demands for protection in regulating working hours, the use of new technologies, reconciling work and family life and preventing risks to workers' health. |
