O cenário atual da jurimetria no processo do trabalho: potenciais impactos às desigualdades entre os litigantes

Abstract

This article examines the impacts of jurimetrics in labor processes, with an emphasis on structural inequalities between habitual and occasional litigants. Through a critical-analytical approach, it is observed that the strategic use of predictive tools by companies that frequently engage in legal proceedings, such as Uber's platform, may compromise the integrity of jurisprudential formation and influence judicial settlements made in contexts of vulnerability. Although jurimetrics offers gains in terms of efficiency and predictability, its benefits remain concentrated among litigants with greater economic power and technical access. In contrast, underprivileged workers face informational and structural barriers that hinder the full exercise of their rights, especially when acting without legal representation. The study concludes that self-composition in these contexts does not always reflect a fair and voluntary solution, and may reproduce existing inequalities. Therefore, it advocates for the need to establish ethical and legal limits on the use of jurimetrics, ensuring that technological innovation is aligned with the promotion of equity, legal security, and the democratic function of jurisdiction.
