| Resumo: | O presente estudo analisa as Leis nº 13.756/2018 e 14.790/2023, regulamentadoras do mercado brasileiro de apostas esportivas on-line, à luz dos princípios do Direito do Consumidor. Com a ascensão desse mercado, surgem desafios relacionados à proteção dos apostadores, especialmente quanto à vulnerabilidade e transparência de informações. Examina-se a aplicação do Código de Defesa do Consumidor (CDC) ao setor, traçando um paralelo entre as casas de apostas e as loterias federais, evidenciando as inovações trazidas pelas leis recentes. Ademais, examinam-se os impactos socioeconômicos das apostas (superendividamento e vício), bem como o caráter predatório da publicidade. Embora as legislações apontadas tenham promovido significativos avanços, evidencia-se a necessidade de aprimoramento das normas. Conclui-se que a mera legislação não é capaz de equilibrar os interesses econômicos do mercado e as necessidades sociais, sendo que a adoção de políticas de educação financeira e tratamento de vícios se mostram fundamentais para a garantia de proteção aos apostadores. |
| Abstract: | This study analyzes Laws 13,756/2018 and 14,790/2023, which regulate the Brazilian online sports betting market, in light of the principles of Consumer Law. With the rise of this market, challenges related to the protection of bettors arise, especially regarding the vulnerability and transparency of information. The application of the Consumer Defense Code (CDC) to the sector is examined, drawing a parallel between bookmakers and federal lotteries, highlighting the innovations brought about by recent laws. In addition, the socioeconomic impacts of betting (over-indebtedness and addiction) are examined, as well as the predatory nature of advertising. Although the legislations mentioned have promoted significant advances, the need to improve the rules is evident. The conclusion is that legislation alone is not capable of balancing the economic interests of the market and social needs, and the adoption of financial education and addiction treatment policies are essential to guarantee protection for bettors. |
